The letter below to Utah Governor Gary Herbert, CMS has announced it will propose an amendment to the ACA Exchanges Final Rule. The amendment (if finalized) will allow Utah to operate (as a state-run exchange) its existing “Small Business Health Options Program (SHOP)” marketplace, while a Federally-Facilitated Marketplace in Utah will offer plans for the individual market. According to the letter “similarly situated” states would have similar opportunities to have both state-run and federally-run marketplaces.
